TERMS AND CONDITIONS FOR BUYBYRAFFLE.COM

By using Buybyraffle.com the participant agrees to abide by the Terms & Conditions shown below.

  1. TERMS AND CONDITIONS OF USE
    1. Welcome to Buybyraffle.com (“BuyByRaffle”, “Our”, “We”). When a participant visits or shop at the websites operated by BuyByRaffle (including BuyByRaffle.com, and any future site operated by BuyByRaffle, collectively, the “sites”), use BuyByRaffle products or services, use BuyByRaffle applications for mobile, or use software (such as Telegram & WhatsApp Bots, or other Channels) or data provided by BuyByRaffle in connection with any of the foregoing (collectively, together with any use of the sites, “BuyByRaffle Services”), BuyByRaffle provides the BuyByRaffle Services subject to the following conditions.
    1. These General Terms and Conditions apply to all BuyByRaffle Participants (“Customers”, “you”) who purchased BuyByRaffle Raffle Tickets (Physical or electronic) via all BuyByRaffle platforms/Channels which includes, but is not limited to the USSD, Website, Mobile Application, WhatsApp, Telegram, Digital Agents Locations, and all our digital retail outlets all over Nigeria.
    1. We offer a wide range of BuyByRaffle Services, and sometimes additional terms may apply. When you use a BuyByRaffle Service, you also will be subject to the guidelines, terms, and agreements applicable to that BuyByRaffle Service (“Service Terms”). If these Terms & Conditions of Use (“Conditions of Use”) are inconsistent with the Service Terms, those Service Terms will control.
  2. PARTICIPATION
    1. To participate via. any of our BuyByRaffle Channels, the Participant shall be required to buy a Raffle Ticket for every product he/she is interested in winn ing. These Raffle Tickets can either be purchased electronically via our online channels.
    1. The benefit of each Raffle Ticket purchased includes- entry into the BuyByRaffle draw to win the product and CashTokens.
  3. PRICING
    1. Excep t where noted otherwise, the price of the Raffle Ticket displayed for products on any BuyByRaffle platform represents the unit price of each Raffle Ticket.
    1. To reserve a Raffle Ticket for a participant, payments are charged at the time of purchase.
  4. DRAWS
    1. Upon the purchase of a Raffle Ticket by a Participant, the Participant shall gain automatic entry into the BuyByRaffle Draw to win such product.
    1. Draws shall be automated, random, and conducted with utmost good faith by BuyByRaffle. 
  5. WIN AND PRODUCT REDEMPTION
    1. Where a Participant wins from the BuyByRaffle Draw, we shall notify such Participant of the product won and the means of redeeming the product won. The Participant may redeem the Product won either onsite (at the BuyByRaffle office), at merchant location or via. delivery to the Participant Location.
    1. Where there is a dispute as to who will be entitled to any Product Won, we shall verify to our satisfaction, the person who participated in the BuyByRaffle draw and shall ensure such a person gets the Product Won. For the avoidance of doubt, we shall not transfer a product to a person who did not participate in the BuyByRaffle merely because he/she is the owner of a User ID.
    1. Except where otherwise specified, we reserve the right to pass on to a Participant any fees, costs, charges, taxes, imposts, levies, or duties we incur in transferring the product won to such Participant.
    1. We shall transfer to the Participant any cost incurred in verifying his identity where a dispute arises as a result of the Participant’s failure to enter a User ID that belongs to him/her.
    1. We reserve the right to stop a transfer of any product won to a participant if we consider that such act of transfer may be illegal or may aid in the commission of an illegal act.
    1. We will not be liable for any delayed or lost mail, nor will we be liable if a Participant does not receive the Product Won as a result of any incorrect information provided by such Participant to us.
    1. We further reserve the right to withhold the transfer of the product won by a Consumer if the Consumer’s Registration details are false or misleading or if Consumer is unable to verify their identity by meeting our identification verification requirements to our full satisfaction.
    1. Any Participant who Wins from the BuyByRaffle draw shall consent to and be available for the official presentation of their Wins at our expense.
    1. Any Participant who wins hereby agrees to the use of any pictures, video or other media obtained under Clause 3.8 above, on any media channels selected by us upon prior notice to the Participant.
    1. A Participant may nominate representative to be present at the presentation of the product won.
  6. PRIZE MONEY REDEMPTION
    1. Where the Product/prize won is the BuyByRaffle Spend money, you agree that:
      1. You shall only spend the amount won at a participating partner location which will be provided to you.
      1. Where you opt for Cash payment instead of spending the money at any partner location, you shall only be entitled to 50% of the value of spend money won, less statutory charges. The remaining value will be delivered as reward to all other participants.
  7. CONDITION FOR WIN

A Participant shall only be entitled to a Product Won after a successful BuyByRaffle draw was conducted and their Raffle Ticket emerged winner.

  • USER PROFILE EDIT

The Participant must provide documented and verifiable proof of ownership to us for an update to be done on his/her profile.

  • UNCLAIMED WINS
    • Upon the expiration of a period of not less than 180 days following any Draw, we shall retain any Unclaimed product Won and another draw shall be conducted for another participant to win such product.
    • The participant will be liable to refund all legitimate expenses incurred in finding and paying such winners.
    • Where a winner pre-deceases the claiming of his/her Win, the Product shall be transferred to the personal representative of the deceased winner on presentation of Letters of Administration or Probate issued by the High Court.
    • Nothing in these Terms and Conditions shall make us liable to the Estate of a deceased winner for product already transferred to the deceased person prior to his death.
  • PRODUCT RETURN & COMPENSATION
    • Some items may not be returnable or refundable. Where a participant wins a product from the BuyByRaffle draw, such product may be returned where the product delivered to the recipient is defective (i.e., where the product is not working, or the product is incapable of functioning properly for the purpose for which it was created) or where the product delivered to the recipient has expired.
    • This rule for product return is subject to our return and refund policy.
  • OUT OF STOCK SITUATION
    • We shall ensure that every participant who wins a product from the BuyByRaffle draw receives the product won.
    • Where the participant wins from the BuyByRaffle daw and the product is unavailable, we shall replace such product won with an alternative product (with reasonably equal value) to be determined by us.
    • Where there is no alternative product, we shall inform such participant of the situation and he/she shall be allowed to choose another product from a variety of products presented by us to him/her as a replacement.
  • TAXES

Each winner is responsible for paying any and all taxes on any Wins, as may be required.

  1. DISQUALIFICATION
    1. We reserve the right to disqualify any entry that does not/appears not to follow the communicated terms and conditions at our absolute discretion.
    1. An entry submitted with falsified information or documents is automatically disqualified.
  2. CASHTOKENS
    1. The CashToken is a consumer loyalty reward commodity. Each CashToken entitles its recipient to Guaranteed Instant cash of N 6 (Six Naira) and Automatic entry into the CashToken draw to win between N 5,000 (Five Thousand Naira) and N 100,000,000 (One Hundred Million Naira).
    1. You shall receive a CashToken upon your purchase of every Raffle Ticket and you shall be subject to the terms and conditions applicable to the recipient of a CashToken. These terms and conditions are available at: https://ng.cashtoken.africa/terms-and-conditions
  3. ELECTRONIC COMMUNICATIONS
    1. When a participant uses any BuyByRaffle Service, or send e-mails to us, the Participant is communicating with us electronically.
    1. The participant consents to receive communications from us electronically. We will communicate with such participant by e-mail, SMS or by posting notices on the sites or through the other BuyByRaffle Services. The Participant agrees that all agreements, notices, disclosures, and other communications that we provide to them electronically satisfy any legal requirement.
  4. COPYRIGHT AND TRADEMARKS
    1. All content included in or made available through any BuyByRaffle channel, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations is the property of BuyByRaffle or its content suppliers and protected by Nigerian and international copyright laws.
    1. The compilation of all content included in or made available through any BuyByRaffle platform is the exclusive property of BuyByRaffle and protected by Nigerian and international copyright laws.
    1. In addition, graphics, logos, page headers, button icons, scripts, and service names included in or made available through any BuyByRaffle platforms are trademarks or trade dress of BuyByRaffle in Nigeria and other countries.
    1. BuyByRaffle’s trademarks and trade dress may not be used in connection with any product or service that is not BuyByRaffle’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits BuyByRaffle.
    1. All other trademarks not owned by BuyByRaffle that appear in any BuyByRaffle Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by BuyByRaffle.
  1. LICENSE AND ACCESS
    1. Subject to a participant’s compliance with these Conditions of Use, BuyByRaffle or its content providers grant such participant a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the BuyByRaffle channels. This license does not include any resale or commercial use of any BuyByRaffle channel, or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any BuyByRaffle Service or its contents; any downloading or copying of account information for the benefit of another person; or any use of data mining, robots, or similar data gathering and extraction tools.
    1. All rights not expressly granted to a participant in these Conditions of Use or any Service Terms are reserved and retained by BuyByRaffle or its licensors, suppliers, publishers, rightsholders, or other content providers.
    1. No BuyByRaffle Service, nor any part of any BuyByRaffle Service, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of BuyByRaffle.
    1. Participants may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of BuyByRaffle without express written consent.
    1. Participants may not use any meta tags or any other “hidden text” utilizing BuyByRaffle’s name or trademarks without the express written consent of BuyByRaffle.
    1. Participants may not misuse the BuyByRaffle platforms.
    1. Participants may use the BuyByRaffle Services only as permitted by law.
    1. The licenses granted by BuyByRaffle terminate if a participant does not comply with these Conditions of Use or any Service Terms.
  2. YOUR ACCOUNT
    1. Every participant is responsible for maintaining the confidentiality of their account and password and for restricting access to their computer or mobile devices. Participants accept responsibility for all activities that occur under their account or password.
    1. BuyByRaffle does not sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method.
    1. If you are under 18, you may not use the BuyByRaffle platform.
    1. BuyByRaffle reserves the right to refuse service, terminate accounts, remove, or edit content, or cancel orders in its sole discretion when a customer violates any provision of this Terms and Conditions, especially with relation to Clause 5.7, Clause 12, Clause 16.6, Clause 16.7, and Clause 16.8.
  3. PRODUCT DESCRIPTIONS

BuyByRaffle attempts to be as accurate as possible. However, we do not warrant that product descriptions or other content of any BuyByRaffle Service is accurate, complete, reliable, current, or error-free. If a product offered by BuyByRaffle itself is not as described, the Participant’s sole remedy is to return it in unused condition.

  • OTHER BUSINESSES

BuyByRaffle may provide links to the sites of affiliated companies and certain other businesses. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any of these businesses or individuals or the content of their Web sites. BuyByRaffle does not assume any responsibility or liability for the actions, product, and content of all these and any other third parties. Participants should carefully review their privacy statements and other conditions of use.

  • DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
    • The BuyByRaffle services and all information, content, materials, products (including software) and other services included on or otherwise made available to a participant through the BuyByRaffle services are provided by BuyByRaffle on an “as is” and “as available” basis, unless otherwise specified in writing. BuyByRaffle makes no representations or warranties of any kind, express or implied, as to the operation of the BuyByRaffle services, or the information, content, materials, products (including software) or other services included on or otherwise made available to you through the BuyByRaffle services, unless otherwise specified in writing. You expressly agree that your use of the BuyByRaffle services is at your sole risk.
    • To the full extent permissible by applicable law, BuyByRaffle disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. BuyByRaffle does not warrant that the BuyByRaffle services, information, content, materials, products (including software) or other services included on or otherwise made available to you through the BuyByRaffle services, BuyByRaffle’s servers or electronic communications sent from BuyByRaffle are free of viruses or other harmful components. BuyByRaffle will not be liable for any damages of any kind arising from the use of any BuyByRaffle service, or from any information, content, materials, products (including software) or other services included on or otherwise made available to you through any BuyByRaffle service, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing.
    • Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.
  • GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and Conditions shall be governed, interpreted, and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to principles of conflicts of law. If any dispute or claim arises out of or in relation to this Agreement, such matter shall be settled through direct discussions between us and the Participant.

  • MODIFICATION AND SEVERABILITY

We reserve the right to make changes to the sites, policies, Service Terms, the Privacy Policy, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

  • ADDITIONAL BUYBYRAFFLE SOFTWARE TERMS
    • Use of the BUYBYRAFFLE Software. Participants may use BUYBYRAFFLE Software solely for the purposes of enabling the participant to use and enjoy the BUYBYRAFFLE Services as provided by BUYBYRAFFLE, and as permitted by the Conditions of Use, these Software Terms, and any Service Terms. Participants may not incorporate any portion of the BUYBYRAFFLE Software into their own programs or compile any portion of it in combination with their own programs, transfer it for use with another service, or sell, rent, lease, lend, loan, distribute or sub-license the BUYBYRAFFLE Software or otherwise assign any rights to the BUYBYRAFFLE Software in whole or in part. Participants may not use the BUYBYRAFFLE Software for any illegal purpose. We may cease providing any BUYBYRAFFLE service and we may terminate participant’s right to use any BUYBYRAFFLE service at any time. Participants rights to use the BUYBYRAFFLE platform will automatically terminate without notice from us if participants fail to comply with any of these Software Terms, the Conditions of Use, or any other Service Terms. Additional third-party terms contained within or distributed with certain BUYBYRAFFLE Software that are specifically identified in related documentation may apply to that BUYBYRAFFLE Software (or software incorporated with the BUYBYRAFFLE Software) and will govern the use of such software in the event of a conflict with these Conditions of Use. All software used in any BUYBYRAFFLE Service is the property of BUYBYRAFFLE or its software suppliers and protected by Nigerian and international copyright laws.
    • Use of Third-Party Services. When a Participant uses the BUYBYRAFFLE Software, such participant may also be using the services of one or more third parties, such as a wireless carrier or a mobile platform provider. The use of these third-party services may be subject to the separate policies, terms of use, and fees of these third parties.
    • No Reverse Engineering. A participant may not, and must not encourage, assist, or authorize any other person to copy, modify, reverse engineer, decompile or disassemble, or otherwise tamper with, the BUYBYRAFFLE Software, whether in whole or in part, or create any derivative works from or of the BUYBYRAFFLE Software.
    • Updates. In order to keep the BUYBYRAFFLE Software up to date, we may offer automatic or manual updates at any time and without notice to the participant.
  • DEFINITIONS

In these Terms and Conditions, the following terms as used in these Terms and Conditions shall have the meaning ascribed to them hereunder:

  • “Application Channels” means USSD, Website, Mobile Application, WhatsApp, Telegram, Agents Locations and all our retail outlets all over Nigeria;
    • “CashTokens” means an electronic reward commodity, which qualifies the recipient for guaranteed instant cash and an opportunity to win up to N 100,000,000 at weekly draws.
    • “Consumer/Participant” means any person who purchases a Raffle Ticket on any of the BuyByRaffle Channels in accordance with these terms and conditions;
    • “Draw” means the approved selection process by which the winner(s) are determined on a random basis across the Win levels;
    • “Estate” means the collective assets and properties of a deceased Participant;
    • “Legal Age” means the age at which a person enters into full adult legal rights and responsibilities. The legal age is 18 in Nigeria.
    • “Media Channels” includes but is not limited to: posters, newspapers, billboards, social media, websites.
    • “National Lottery Act” means CAP N145 LFN 2010; together with other subsidiary legislation made pursuant to it.
    • “NLRC” means the National Lottery Regulatory Commission
    • “Terms and Conditions” means the general terms and conditions as contained herein.
    • “Third-Party Channel/ 3rd Party Channel” means any approved channel for the purchase of Raffle Tickets.
    • “User ID” means a unique identifier (Nigerian Phone Number duly registered with a Mobile Nigerian Number) for each Participant on the BuyByRaffle Platform
    • “Valid ID”: An acceptable Nigerian Government issued identity card. This includes Driver’s License, National Identity card and/or a valid International Passport.
    • “Win” means the Product which any Participant is entitled in accordance with this General Terms and Condition.
